Employment Law Brief The Clapton Commercial Construction Company located in Detroit, Michigan, is planning to expand its business into the state of Arizona. It is a medium-sized company with 650 employees and possibly increasing an additional 20% in the new state. Prior to the move, the human resources (HR) department must be aware of applicable employment laws that may affect the business.Outlined below are brief summaries and consequences for noncompliance of the following employment laws: Title VII of the Civil Rights Act of 1964, the Immigration Reform and Control Act (IRCA), he American with Disabilities Act of 1990 (ADA), and the Fair Labor Standards Act of 1938, as amended (FLSA). Relevant Employment Laws Title VII of the Civil Rights Act of 1964 is the first employment law to consider. It prohibits discrimination on the basis of race, color, religion, sex, or national origin in aspects of employment such as hiring, wages, assignment, promotions, benefits, and discipline. Titl e VII is the most important federal Equal Employment Opportunity law because it contains the broadest coverage, prohibitions, and remedies† (Cascio, 2013, p. 83). Under the law, the Equal Employment Opportunity Commission (EEOC) exists o implement laws dealing with employment discrimination. According to Cascio (2013), the law was expanded in 1972 to cover almost all public and private employers with 1 5 or more employees; except private clubs, religious organizations, and Indian reservations. The EEOC has the authority to conduct investigations, create resolution programs, and file lawsuits.Failure to comply with Title VII exposes the employer to both civil and criminal lawsuits with possible outcomes of fines, compensatory and punitive damages, or even imprisonment. The company may also have to reinstate or promote the affected employee. In 1991, the Act amended several statues enforced by the EEOC. Parties were able to obtain Jury trials and recover compensatory and punitiv e damages with cases involving intentional discrimination. The Act also placed monetary caps for future cases based on size of the company.Another provision was enforcement of those American controlled companies abroad. The next employment law to consider is the Immigration Reform and Control Act of 1986. This law applies to employers regardless of size and every employee regardless of status: full-time, part time, or seasonal. The IRCA prohibits employers rom hiring or continuing to employ personnel which are not legally authorized to work in the United States. The Clapton Commercial Construction Company is expanding business to Arizona with the intent of increasing the number of employees by 20%.The company must consider the demographics of that area with regard to potential employees and take measures to ensure an employee has documents to work legally in the United States, such as a passport or resident alien card. Other examples are located on the Employment Eligibility Verific ation 1-9 form that potential employees are required to complete. Penalties for noncompliance may esult in fines for each violation and denial of federal contracts. According to the Department of Homeland Security (2013), in fiscal year 2010, Immigration and Customs Enforcement removed more than 392,000 illegal workers nationwide.The American with Disabilities Act of 1990 (ADA) is another law to consider. â€Å"Almost 13% of people ages 21 to 64 in the United States have at least one disability, a percentage that more than doubles to 30. 2% for people ages 65 to 74† (Cascio, 2013, p. 89). The ADA prohibits an employer from discriminating against a qualified person with a disability. A qualified person is someone who can perform the essential unctions of a Job with or without accommodation. The physical or mental impairment that limits one or more major life activities is called a disability, such as seeing, walking, hearing, or talking.The ADA expanded protection of drug and alcohol rehabilitation and those individuals who have tested positive for HIWAIDS. The ADA applies to private employers with 15 or more employees, state and local governments, employment agencies, and labor unions. The Clapton Commercial Construction Company is not required to lower work standards or tolerate misconduct on the Job; however, reasonable accommodations must be made to assist ualified Job applicants. For example, the company can purchase a computer screen magnifying glass for the vision impaired. The EEOC enforces the provisions outlined in the ADA.

(8 marks) Answer a) Cast parts can range in size from a fraction of an inch and a fraction of an ounce to over 30 feet and many tons.Moreover, casting can incorporate complex shapes, hollow sections or internal cavities, and irregular curved surfaces. b) In investment casting a pattern is formed from a low melting temperature, low vaporization temperature material, often wax. The mold is produced by surrounding the pattern with the mold material. The mold cavity is produced when the pattern is removed by melting/vaporizing the pattern. In early process development with porous mold materials the melted wax from the pattern would migrate into the mold material and be lost. ) Heat treatments (described in Chapter 4) such as quenching and tempering, among others, are carried out to optimize the grain structure of metal castings, thereby controlling and enhancing mechanical properties. Heat treating can control microporosity, which is a main reason that castings are weak in tension. 2. a) What are some of the attractive features of die casting compared to alternative casting methods? b) For the cast metal wheel illustrated in Figure below, show how (a) riser placement, (b) core placement, and (c) chills may be used to help feed molten metal and eliminate porosity in the isolated hub boss. ) What are some of the general defects encountered in casting processes? Name and briefly describe three. (8 marks) Answer a) Die casting is characterized by extremely smooth surface finishes, excellent dimensional accuracy, and high production rates. A single set of dies can produce many thousand castings without significant changes in dimension. b) Solutions; i) Riser ii) Core iii) Chills c) General defects include; v) misruns, in which the casting solidifies before filling the mold cavity v) cold shuts, in which two portions of metal flow together but there is lack of fusion at the joint; vi) cold shots, where solid globules of cast metal become entrapped in the casting; vii) shrinkage cavity, which is a depression on the casting surface or an internal void in the casting caused by solidification shrinkage; viii) microporosity, which is a network of small voids throughout the casting caused by localized solidification shrinkage; and ix) hot tearing, which is a crack in the casting caused by a mold that does not ield to the metal during the early stages of solidification shrinkage. 3. a) How does the fabrication of a thermoplastic polymer differ from the processing of a thermosetting polymer? b) What are the significant differences in the equipment and operating procedures between injection mold- ing of thermoplastics and injection molding of the rmosets? c) Can thermosetting plastics be used in injection molding? Explain. (8 marks) Answer a) Thermoplastic polymers can be heated to a temperature at or near the melting temperature so that the material becomes either a formable solid or a liquid.The polymer can than be cast, injected into a mold, or forced through a die to produce the desired shape. With thermosetting polymers, once the polymerization has occurred, no further deformation can occur. Thus, the polymerization reaction and the shape-forming process must be accomplished simultaneously. b) The differences in injection molding of thermosets are (1) shorter barrel length, (2) lower temperatures in the barrel, these first two reasons to prevent premature curing; and (3) use of a heated mold to cause cross-linking of the TS polymer. c) Thermosetting plastics are suitable for injection molding.The basic modification which must be made to the process is that the molds must be heated to allow polymerization and crosslinkin g to occur in the mold cavity. The major drawback associated with this change is that, because of the longer cycle times, the process will not have as high a production rate as injection molding of thermoplastics. 4. a) Identify one injection molding process could be used to inject a single part with two or more different material as shown below. b) Describe process mechanism c) List and explain THREE (3) advantages of this technology? (8 marks) Answer a) Multi-shot injection molding ) This process ables to to shoot two or more different materials into the same mold, into different locations, resulting in parts with increased functionality, improved cosmetics, and multiple mechanical properties. c) Advantages; i) Reduced cycle time * Compared to multiple molding cycles of separate components, molding multiple materials in the same cycle has obvious time and labor benefits. ii) Reduced part cost * Combine reduced cycle times, reduced labor times, and eliminated assembly operations, a nd the total cost of multi-shot molded parts becomes less, compared to alternative single-shot methods. ii) Improved Adhesion * With multi-shot molding we get a true physical bond, resulting in a much stronger, longer lasting bond, compared to more traditional â€Å"skin on skin† insert molding or post-molding assembly. 5. d) What are sheet-molding compounds (SMCs)? Bulk-molding compounds (BMCs)? e) What are some of the forms in which reinforcement fibers appear in composite materials? f) Describe the problems involved in recycling products made from reinforced plastics. (8 marks) Answer a) Sheet molding compounds are sheets composed of chopped fibers and resin, the sheets being about 0. inch in thickness. These can be press-formed in heated dies to provide an alternative to sheet metal where light weight, corrosion resistance and integral color are desired. Bulk-molding compounds are fiber-reinforced thermoset molding materials containing short fibers in random orientation. They are formed into products using processes like compression molding, transfer molding or injection molding. b) Fiber-reinforced composites use the strength of the fibers to impart additional strength to the fiber-matrix whole.The use of fibers means that added strength will be in the fiber length direction. The commonly used fiber forms are; i) long, continuous fibers are their use results in increased strength in the fiber length direction, ii) fibers woven into fabric layers used in thin sheet composites and they add strength in the two in-plane fiber directions, iii) woven fabrics of fibers formed in three dimensions so that when embedded in the matrix strength in three dimensions is increased, iv) short, chopped fibers that can be oriented in a particular direction or randomly. ) The main problems are that recycling usually requires the use of a single type of material, and that some plastics (mainly hard and brittle polymers) are more difficult to chop into small pieces for further processing than others. With reinforced plastics, this requires that the reinforcement be separated from the matrix, a very difficult task and uneconomical task. Note that matrices are often thermosets, so it is not practical to melt the matrix and separate the fibers from a molten phase. 6. ) In the casting of steel under certain mold conditions, the mold constant in Chvorinov's Rule is known to be 4. 0 min/cm2, based on previous experience. Principal photography of the film begun in Norfolk, S omerset and Gloucestershire in April 2011, all these locations are in England. The premiere of the film was on 26 February 2013. Storytelling    The power of storytelling in the film, whereby the film depicts a bedtime story that giants wandered about England consuming and crushing anyone on their way. After recurring wars between human beings and the giants, a permanent solution hatched. This solution was a powerful crown that possessed magic. The wearer of this crown who was King Eric could control and tame the giants. King Erik sent away the giants back to their homeland of Gargantua. After sometime, King Erik died and he is buried together with beanstalks and the magical crown. Time passes and the legend of King Erik is becomes a narration to children Isabelle the princess and Jack a peasant as a bedtime story. Both Isabelle and Jack grow to become young attractive youths. While Isabelle runs from a forced marriage to Lord Roderick, she bumps into Jack and they develop a bond to each other. While Isabelle is with Jack at his place, suddenly a magic bean plants itself and grows to take Isabelle to the clouds, to Gargantua where she remains stranded.    If one watches the TV spots and trailers of Jack the Giant slayer, they will discover that the marketing is quite poor relative to the movie. The action sequence is not as creative and flowing as the legend itself. Bryan Singer the director of the movie seems more concerned with old traditional story telling than the targeted audience.     The movie has gently tried to twist the original and much familiar story. Isabelle and Jack both have a good childhood since they have parents who read for them. The movie depicts the importance of storytelling in child upbringing and development. Jack the Giant Slayer, as most fables are full of good life lessons. Life lessons come in the stories of scary villains, dangerous adventures, villains and courageous heroes who challenge them. Fairy tells highlight virtue s of self-sacrifice and bravery. Storytelling shows the evils of selfishness, jealousy and greed. The mother of the princess uses storytelling to motivate her young daughter to emulate the heroes in the fairy tells and to practice good things in the world.   We can attribute Jacks attitude to the stories he grew up listening. For instance, his heroism and bravery is because he emulates the heroes in the stories.   Acting Acting is not impressive. The actors are Nicholas Hoult acting as Jack the farmhand, Eleanor Tomlinson acting as Isabelle the youthful princess (Goodykoontz& Jacobs, 2011). Other actors are Stanley Tucci acting as Lord Roderick the Kings adviser, Ian McShane acting as King the princess father and Billy Nighy as Fallon the leader of the giants. The acting is poor, Nicholas Hoult who is acting as Jack the peasant has an odd haircut and he is just an average actor.
